Please ensure that you read carefully the following Terms and Conditions of Sale. You are stating your acceptance of these Terms and Conditions of sale when you place an order. These Terms and Conditions do not affect your statutory rights.
Order acceptance
All orders placed in the ColorCode 3-D Store at Sirius 3-D ApS are subject to these Terms and Conditions of sale, which constitute a binding agreement between Sirius 3-D ApS (the Seller) and its customers (the Buyer).
Receipt of an order does not constitute acceptance of an order. We reserve the right to refuse an order for any reason including stock shortages, failure to obtain authorisation of payment, pricing or product description errors. Order acceptance will take place on the despatch of the Products ordered by the Buyer. No order submitted by the Buyer shall be deemed to be accepted by the Seller unless and until the Seller has confirmed by e-mail to the Buyer that the order has been sent.
Payments are accepted on most major credit cards through our secure e-payment system provider ScanNet A/S.
Product Descriptions
Sirius 3-D ApS take great care in the faithful reproduction of all descriptions, specifications and product illustrations, as provided to us by the manufacturers, unfortunately however errors may occur from time to time for which we accept no liability. If you are uncertain about the suitability of a product please contact our sales department for more details. All illustrations are representative of the product only and are subject to manufacturing tolerances. We reserve the right to alter specifications as advised by the manufacturers. All data containing specifications, weight, dimensions, qualities and the like contained in the Seller's catalogue or other literature are hereby declared to be approximate only (or where tolerances are prescribed to be within those tolerances) as are also weight and dimensions of shipment.
Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document relating to the sale or advertisement of Products shall be subject to correction without liability on the part of the Seller.
The responsibility for ensuring the accuracy of any order submitted, including the accuracy of a delivery address, falls to the Buyer. The Buyer shall be responsible to the Seller for ensuring the accuracy of the terms of any order (including any applicable specification) submitted by the Buyer.
Any advice or recommendation given by the Seller or its employees or agents to the Buyer or its employees or agents as to the specification, application or use of the Products which is not confirmed in Writing by the Seller is followed or acted upon entirely at the Buyer's own risk, and accordingly the Seller shall not be liable for any such advice or recommendation which is not so confirmed.
Prices
Individual quoted prices exclude shipping charges. Shipping charges are calculated for the total shipment and are shown during Checkout. The method of packaging and delivery are totally under the control of the Seller.
Any special packaging or delivery (Business 2 Business only) may be subject to additional cost. Please contact our sales department if you have a special delivery requirement.
All prices are given by the Seller on a supply and delivery basis and to the agreed delivery address and do not cover installation.
The price of the Products shall be the Seller's quoted price. The price is inclusive of value added tax (VAT), which the Buyer is liable to pay to the Seller for any EU supplies for which VAT deferment is not applicable.
Credit card payments
We only accept on-line credit card payments through our secure e-payment provider ScanNet A/S. We are able to accept Diners Club, MasterCard, Visa, Visa Electron, JCB, Dankort and Visa/Dankort.
Delivery
The Seller shall make delivery of the Products to the address given in the order from the Buyer.
We aim to dispatch orders within 3 business days from the Buyers order date however this cannot be guaranteed. Further we aim to deliver the download login and Serial number for orders of downloadable products within 1 business day from the buyers order date however this cannot be guaranteed. If for any reason we cannot dispatch an order within 14 days from the Buyers order date the Buyer will be notified and given the option of cancelling the order with a full refund.
The Buyer shall not be entitled to refuse to accept the Products because of late delivery.
Order Cancellations and Rights of Return
You may cancel your order at anytime within 2 working days from your order date. You have the right to return unopened Products within 14 days from receipt. When we have received the unopened Products you will get a refund according to the Invoiced amount, however you will have to pay the shipping fee for the return of the Products. If you wish to return your order it is strongly recommended to contact us for a Returns Number and the correct address for returns. This is not mandatory, but it will ensure a faster and more secure process. Refunds will be granted only under the strict condition that Buyer's ensure that reasonable care is taken of the Products, that they are still in their original wrapping and condition as received including instructions and accessories. After 7 days of receiving the Products, refunds will be given at the discretion of the Company Management. Note: Downloaded software can neither be returned nor refunded and Orders for custom made Products can neither be cancelled nor returned.
Product Guarantee
Subject to the conditions set out below the Seller warrants that the Products will correspond with their specification at the time of delivery and will be free from defects in material and workmanship for a period of 24 months from delivery. Note: This warrants covers neither the disposable ColorCodeViewer nor custom made Products.
If you believe Products you have purchased from ColorCode 3-D Store at Sirius 3-D ApS are defective please report this as soon as possible to our customer service department. Where any valid claim in respect of any of the Products which is based on any defect in the quality or condition of the Products or their failure to meet specification is notified to the Seller in accordance with these Conditions, the Seller shall be entitled to replace the Products (or the part in question) free of charge or, at the Seller's sole discretion, refund to the Buyer the price of the Products (or a proportionate part of the price), but the Seller shall have no further liability to the Buyer. The Seller does not cover any losses, defects or damage caused in transit.
The Seller shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow the Seller's instructions (whether oral or in writing), misuse or alteration or repair of the Products without the Seller's approval.
Privacy Policy
Sirius 3-D ApS only uses the information supplied by you to process and fulfil your order. We will not divulge any information we obtain from you to any third party unless legally required to do so. We will not use, sell or otherwise divulge your e-mail address for any purpose other than the transmission of information directly relating to your order. Credit card details submitted on-line via ScanNet A/S are not seen by us at any time and are not kept in any form on our Servers.
General
Nothing in these Terms and Conditions shall operate so as to confer any rights on a third party.
The laws of Denmark shall govern these Terms and Conditions and the Buyer agrees to submit to the exclusive jurisdiction of the Danish courts.
